
The Council of Ministers has given the green light to the decree-law for the implementation of the European Union pact on migration and asylum.

«A Copernican revolution» to «accompany the immediate entry into force of these rules, also strong in the fact that as a government we believe we have been key players in the reform process of the asylum system at a European level,» said Interior Minister Matteo Piantedosi at a press conference. «With this intervention, without weakening the other initiatives we have launched, such as the migration and asylum bill already progressing» in Parliament, he added, «we wanted to anticipate those that allow us to give immediate implementation to this new regulatory process by the European Union starting from June 13.»
The intervention serves to make «immediately operative, starting from June 12, 2026, the date of application of the EU Pact on migration and asylum, the border asylum procedures that Union law makes mandatory for certain categories of applicants.»

In implementation of the European Commission’s decision, which quantified the adequate capacity of Member States and the maximum annual number of applications to be examined under the border procedure, Italy «will have to examine, under the border procedure, in the first period of application between June 12, 2026, and June 12, 2027, up to 16,032 applications annually.»
The border procedure, in implementation of the provisions of the new Pact, will be mandatory for individuals dangerous to national security, coming from countries with an application acceptance rate lower than 20 percent; who have submitted false information or documents. Border procedures, under the new Pact, «must conclude within a maximum overall period of twelve weeks. Hence the need for the national legal system to set: the terms of the administrative phase and those of the judicial phase in a manner consistent with this maximum limit; to provide the necessary reinforcements for the administrative and judicial offices that will be involved in the aforementioned activity.»
